These Terms of Service ("Terms") form a legally binding agreement between you ("you", "your", "User") and Ruan Haarhoff, operating as Hyper Parameter Oasis ("we", "us", "our"), governing your access to and use of hyperparameter-oasis.ai and its API (the "Service").
By registering an account or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy and Acceptable Use Policy, which are incorporated herein by reference.
If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
Hyper Parameter Oasis is an API-first developer tool for parameter search and experiment optimisation. The Service accepts numerical experiment configurations and results submitted via API, and returns numerical configuration proposals to guide subsequent experiments. It does not generate content, produce outputs involving personal data, or make decisions on your behalf.
The Service is currently provided in beta. Features, pricing, and behaviour may change during this period. We will endeavour to provide reasonable notice of material changes where practicable.
To use the Service you must register an account with a valid email address and password. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
You must notify us promptly at [email protected] if you suspect unauthorised access to your account. We are not liable for losses arising from unauthorised use of your account where you have failed to take reasonable steps to protect your credentials.
You may not create multiple accounts to circumvent usage limits, token balances, or any enforcement action taken against a prior account.
The Service issues API keys to enable programmatic access. API keys carry the same access rights as the account that generated them. You are responsible for keeping API keys confidential and for all usage made with your keys. Revoke any key you believe has been compromised via your account dashboard.
Access to certain features of the Service requires a prepaid token balance. Tokens are purchased in advance and deducted as you use the Service.
Payments are processed by a third-party payment provider. By making a payment you also agree to their terms of service. We do not store your card details.
Your use of the Service is subject to our Acceptable Use Policy. Violations may result in immediate suspension or termination of your account without refund.
You retain ownership of the experiment configurations, parameter values, and result data you submit to the Service ("Your Data"). By submitting Your Data, you grant us a limited licence to process and store it for the purpose of operating and improving the Service, including use in aggregated, anonymised form to inform platform-wide optimisation.
We will not sell Your Data to third parties or use it to identify you in aggregated analyses. See our Privacy Policy for full details.
The Service is provided in beta and on an "as available" basis. We do not guarantee any specific level of uptime or availability. We may take the Service offline for maintenance, upgrades, or other operational reasons at any time.
During the beta period, we reserve the right to modify, restrict, or discontinue any feature or the Service as a whole, with or without notice.
All intellectual property in the Service — including the optimisation engine, platform software, visual design, and documentation — remains the exclusive property of Ruan Haarhoff. These Terms do not transfer any ownership or licence in that property to you beyond what is necessary to use the Service as described.
You retain all intellectual property rights in Your Data and in any models, configurations, or workflows you develop using outputs from the Service.
To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that configuration proposals produced by the Service will improve your experiment outcomes. Results depend on many factors outside our control, including your experimental setup, data quality, and domain.
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
Our total aggregate liability to you for any claim arising under or in connection with these Terms shall not exceed the total amount you have paid to us in the 90 days preceding the event giving rise to the claim.
You agree to indemnify and hold harmless Ruan Haarhoff and any associated personnel from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service in violation of these Terms or applicable law.
You may close your account at any time by contacting us. We may suspend or terminate your account at any time, with or without notice, for violation of these Terms or our Acceptable Use Policy, or for any other reason at our discretion.
On termination, your right to access the Service ceases immediately. Any remaining token balance is subject to our refund discretion as described in section 5. We will retain your data for the periods described in our Privacy Policy.
These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.
Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, except that we reserve the right to seek injunctive or other equitable relief in any jurisdiction to protect our intellectual property.
We may update these Terms from time to time. We will indicate the date of the most recent update at the top of this page. For material changes, we will attempt to notify registered users by email. Continued use of the Service after updated Terms are posted constitutes your acceptance of the changes.
